Privacy policy
1. Who is responsible
The controller of your data is OMNIRA GROUP LLC, a limited liability company registered in New Mexico (United States), identified by EIN 42-2083272 (United States federal tax ID), with registered address at 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States. For any question about your data you can write to support@omnistgroup.com.
Dancezy AI is an app that creates a dance video with artificial intelligence from a photo you upload and a dance you choose.
2. What data we process
We only process what is needed to create your videos and to keep the service from being abused:
- The photos you upload. They may show your face, other people's faces or your pet. Before uploading, the app resizes the photo on your device.
- The videos generated from those photos.
- An anonymous account identifier. The app creates an account without asking for your name, email or phone number.
- A device identifier generated at random by the app itself and stored on your device. It is not the advertising identifier or any serial number.
- A fingerprint of your IP address. We do not store the address itself: we turn it into a code that cannot be reversed and is only used to apply usage limits.
- A record of what you accept: the version and date on which you accepted how we handle your photo, and the version and date of your confirmation that you may use each photo.
- If a dance is designed for a boy or for a girl, what you indicate about the photo. It is stored on your device and sent when creating the video to check that the dance fits.
- Your credit balance and its movements (charges, refunds and top-ups), and the status of your subscription.
- Technical data for each video: the dance chosen, the date, whether it completed or failed, and the AI-generated content label included by the provider.
Purchases are paid through the App Store or Google Play. We never see or store your card details.
The app contains no advertising and no third-party analytics or tracking tools, and it does not sell or share your data for commercial purposes.
3. Automatic checks on the photo
When you upload a photo, our server automatically checks two things: that there is a face large enough for the video to turn out well (except for pet dances) and that the image does not contain disallowed content. If it fails the check, the photo is rejected and deleted.
This detection only locates where a face is in the image. It does not identify anyone, does not compare the face against any database, and does not create or store any biometric profile.
4. Why we use your data and on what basis
- To create the video you ask for and keep it so you can watch and download it: this is the performance of the service you request.
- To send your photo to the artificial intelligence service that generates the video: we do this with your explicit consent, which we ask for before your first upload and which you can withdraw by no longer using the feature.
- To manage your credit balance, your subscription and your purchases: performance of the contract and compliance with legal obligations.
- To prevent abuse and fraud (upload and video limits, blocking of disallowed content): our legitimate interest in keeping the service safe.
- To label videos as generated with artificial intelligence: a legal obligation.
We ourselves do not use your photos or your videos to train artificial intelligence models, for advertising, or for anything other than creating your video.
5. Who we share your data with
To provide the service we rely on the following providers, which receive only the data needed for the function stated:
- fal (Features & Labels, Inc., United States): generates the videos. It receives your photo and the dance video.
- Alibaba and Google, through fal: fal uses their artificial intelligence models and, under its terms, transfers the content to them. Google's model (Nano Banana) prepares views of the face from your photo, and Alibaba's model (Happy Horse) generates the video from those images and the dance video. Under their own terms, neither uses that content to train their models.
- Supabase (Supabase Pte. Ltd.): hosts the database and the accounts in the European Union (Frankfurt, Germany).
- The server where we store the photos and videos: Hostinger International Ltd., with the server located in Lithuania (European Union).
- Apple, Google and RevenueCat (RevenueCat, Inc., United States): handle payments, subscriptions and purchase verification.
- Resend (Plus Five Five, Inc., United States): sends our team's internal technical alerts, which may include the identifier of a video or of an account, never photos or videos.
We do not share your data with anyone else, unless a law or an authority requires us to.
6. Transfers outside the European Union
The artificial intelligence, payment and alert providers process data outside the European Economic Area: in the United States and, for the Alibaba and Google models, in the countries where those companies provide their services.
Those transfers rely on the safeguards provided by the General Data Protection Regulation, such as the standard contractual clauses approved by the European Commission, which fal includes in its data processing agreement. Alibaba and Google process the content they receive under their own terms.
You can ask us for more information about these safeguards by writing to support@omnistgroup.com.
7. How long we keep your data
- The photo is deleted from our servers 24 hours after you upload it.
- Videos are kept for 15 days and are then deleted automatically. You can delete them sooner from the app; doing so also removes them from our servers.
- fal does not keep a record of each request and deletes the files it generates (the face views and the video) after 24 hours. Google keeps what it receives for a limited time, only to detect abuse; Alibaba, under its own terms.
- The upload log is deleted after 2 days, technical logs after 30 days and internal alerts after 90 days.
- Your credit balance and movements are kept for as long as your account exists and, afterwards, for as long as the law requires.
8. Your rights
You can access your data, correct it, ask for it to be deleted, object to its processing, ask for it to be restricted, ask for its portability and withdraw your consent at any time. To exercise any of these rights, write to support@omnistgroup.com.
You can delete your account and all your data yourself, at any time, from Help & legal > Delete my account and data. Your videos, photos and credit balance are deleted. We only keep the accounting record of credit purchases and charges, with nothing that identifies you, for as long as the law requires.
Because the account is anonymous, we may need to ask you for some detail that lets us locate it in order to handle your request.
If you believe we have not handled your data properly, you can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) or with the data protection authority in your country.
9. Photos of other people and of minors
You may only upload photos of yourself, of your pet, or of people who have given you their permission. We ask you to confirm this every time you create a video.
The app is not intended for anyone under 16 years of age. Only parents or legal guardians may upload a photo of a minor.
If you appear in a video created without your permission, write to us at support@omnistgroup.com and we will remove it.
10. Security
Photos and watermark-free videos are only delivered through signed, temporary links. Connections are encrypted and each account can only read its own data.
11. Changes to this policy
If we change this policy, we will publish the new version here with its date. If the change affects how we handle your photo, the app will ask for your acceptance again before you upload another one.
